Terms of Sales

General Terms and Conditions of Sale of APEF for the use of the site apef.ch

The purpose of these general terms and conditions of sale is to govern the relations between:
• the Association of Parents of Students of Florimont (hereinafter referred to as “APEF”) – Avenue du Petit Lancy 37 – 1213 Petit-Lancy, publisher of the site apef.ch (hereinafter referred to as “the Site”)
• and any natural or legal person wishing to use and/or make a purchase via the APEF website (hereinafter referred to as “the Client(s)
“).

1 – Subject

These general terms and conditions of sale aim to define the contractual relations between APEF and the Client and the conditions applicable to any purchase made through the APEF merchant site. The acquisition of a good on this site implies unconditional acceptance by the Customer of these general terms and conditions of sale.

2 – Characteristics of the goods offered

The products sold are those that appear on the APEF site. These products are available for sale while stocks last. The characteristics of the products and the photos are given for information purposes only. The photographs on the site are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly with regard to colors and cannot have any contractual value. The products offered for sale have mostly been created by students of the Florimont Institute (hereinafter referred to as “the Institute”) and are crafts.

3 – Prices

The prices listed on the site are inclusive of tax in Swiss francs.

4 – Orders and conclusion of the sale

The Customer, who wishes to purchase a product on the site of APEF, must go through the various stages of the purchasing process (summary of the products chosen and placed in the basket, identification, indication of the student’s name and class, choice of payment method and payment under the conditions provided). All of the data provided and the recorded confirmation will constitute proof of the transaction. The confirmation will constitute a signature and acceptance of the operations carried out. APEF will communicate by email the details of the recorded order with its availability date.

The price of purchases made on the Site is due at the time of the order, without discount; payment is made by bank credit card (Visa or Mastercard).

APEF does not have access to confidential information relating to the means of payment. The information entered is encrypted and transmitted to the STRIPE company in a secure manner without APEF or third parties having access to it.

5 – Delivery methods and times

The Customer placing the order undertakes to have his/her order delivered to him/her by his/her child(ren), student(s) at the Institute, in accordance with the procedure that will be set up by Apef and approved by the Institute. If the Customer wishes to collect his/her order himself/herself, he/she must mention this during the order finalization process. A collection schedule at the Institute will then be communicated and the Client agrees to respect it.

Deliveries are made through the Clients’ children and APEF cannot be held responsible in the event of damage during the transport of the students.

The delivery time starts once the payment is registered with our accounting department and varies between 1 and 3 working days.

6 – Guarantees and liability

APEF has taken all the usual precautions to ensure both the reliability of information and secure access to its Site. However, APEF cannot, under any circumstances, guarantee the total absence of material errors, technical deficiencies or other unintentional problems. Similarly, no guarantee can be provided as to the compatibility of the Site with the specific needs and uses of the Customers.

APEF cannot be held responsible for any damage whatsoever linked to the use of its Site, and disclaims all liability for the information contained in other sites that could be linked to its own by a hyperlink or any other means.

7 – Intellectual property rights

All data of any nature whatsoever, and in particular texts, graphics, logos, icons, images, audio or video clips, brands, software, appearing on the Site, are necessarily protected by the copyright, trademark law and any other applicable intellectual property rights.

APEF, in its capacity as publisher of the Site, grants the Client a private, non-collective and non-exclusive right of use over the said content. The Client undertakes under these conditions not to reproduce, summarize, modify, alter and/or rebroadcast, without the express prior authorization of the publisher, any text, title, application, software, logo, brand, information and/or illustration, for any use other than strictly private, which excludes any representation for professional purposes or rebroadcast in number.

Similarly, the Client undertakes not to copy all or part of the Site on another site or an internal company network. APEF cannot be held responsible for the uses made by Clients of the data accessible on the Site.

Any creation of a hyperlink from a website to the Site must be the subject of express authorization from APEF.

8 – Protection of personal data

All Customer data is treated as strictly confidential and APEF undertakes to comply with current data protection legislation.

As such, APEF only uses the Customer’s data for the proper processing of their order. The email address provided when the Customer registers will only be used to inform them of new sales and the Customer may unsubscribe at any time. APEF undertakes not to communicate the Client’s personal data to third parties for commercial purposes.

In accordance with the federal law on the protection of personal data, the Client has the possibility to view, modify or delete his personal data at any time, upon simple request by using the contact form on the Site.

10 – Conditions of use of the Site

Use of the Site is authorized for private use only. Any commercial use, in particular for the purpose of reselling products purchased on the Site to third parties, is prohibited.

Any violation of this obligation will be punished by immediate and definitive exclusion from the circle of authorized Customers. Damages are reserved.

11 – Applicable law

The relations between APEF and the Client are governed by Swiss law.

For any dispute relating to the relations between APEF and the Client, the place of jurisdiction is the location of APEF’s registered office.

Role and Responsibilities of Parent Representatives

Role

  1. Serve as the main point of contact between parents, the class teacher, other teachers, and the APEF representative of their section. The Parent Representative represents all parents to the class teacher for general matters and plays an essential role in communication between the different stakeholders in the life of the Institute.
  2. Contribute to fostering a sense of community between parents and students.
  3. Represent the parents of the students in the class for which they are the Parent Representative.


Responsibilities

  1. Distribute to parents the list of contact information of the students in the class (transmitted by the APEF), making sure to follow the data protection policy, in particular by putting parents email addresses in blind copy (bcc) when sending out mass communication.
  2. Keep up to date on class life and be a listening ear to parents to identify common questions and/or concerns. These exchanges are generally done by email, telephone or during meetings between parents, to be organised on a need basis.
  3. Communicate regularly with the class rep Section Head, either by phone, email, or verbally at a meeting at the school. This informal communication allows each of them to keep abreast of the various relevant issues and facilitates the defusing of any false problems. In that context, the class rep undertakes to observe a duty of reserve and confidentiality that is of paramount importance to the success of their mission.
  4. To meet with the homeroom teacher, if necessary, if recurring questions and/or common concerns of the parents arise. Yet, the school program and pedagogical teaching remain entirely the responsibility of the school's management.
  5. To participate, with all the class reps, in meetings with the director/dean/prefects (depending on the section) and the APEF Head of his/her Section to deal, in an organized and constructive manner, with the various questions raised and initiatives suggested by the parents; these meetings take place twice during the school year, usually in the evening.
  6. Relaying information from the APEF to parents. This mainly involves sending information from the APEF by email and collecting any feedback from parents.
  7. Keeping informed and/or participating in the cultural activities of the school and/or the APEF, depending on the information provided by the school and/or the APEF. To be attentive to the feedback of the participants in order to timely debrief the school via the APEF.
  8. Organise, at least once a year when possible and preferably before the Christmas break, an informal gathering and/or dinner between parents and children in order to create connections and a solid and friendly network of Florimont families.
